This Terms of Service Agreement ("Agreement") governs the use of the software application designated as Stacker! ("Service" or "Project") provided by Webyep (Artem Svitlov) ("Developer"). By accessing, downloading, or using the Service, the user ("User") hereby agrees to be bound by the terms and conditions set forth herein.
The Service is explicitly designated as a non-commercial, public open-source endeavor. The Developer formally declares that the Service generates no revenue, receives no financial contributions, and operates exclusively on a zero-income basis.
The underlying source code of the Service has been manually authored by the Developer and is provided pursuant to the open-source license detailed below.
The core source code for the Service is distributed under the terms of the highly permissive MIT License. This license governs the User's rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software.
All musical compositions and audio content incorporated within the Service are licensed under the Creative Commons Attribution 3.0 License (CC BY 3.0).
Pursuant to this license, the Developer hereby confirms that the authorship and source information for all music are clearly presented and dynamically displayed within the Service's "Playing now" overlay window.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. The Developer makes no warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer does not warrant that the Service will operate without interruption or error.
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or any loss of profits or revenues, arising out of the use or inability to use the Service, regardless of the cause of action.
The Developer reserves the unilateral right to amend or revise these Terms at any time. Continued use of the Service following any such changes constitutes User acceptance of the revised terms.
